- Related technical support and consulting
3. Account Registration
To use our services, you must:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Acceptable Use Policy
You agree NOT to use our services for:
- Sending unsolicited commercial email (spam)
- Sending emails to recipients who have not consented
- Phishing, fraud, or malicious content
- Email bombing or harassment
- Sending deceptive or misleading content
- Distributing malware or viruses
- Any illegal activities or content
- Purchasing, renting, or harvesting email lists
5. Email Compliance Requirements
All emails sent through our infrastructure must:
- Include a valid physical postal address (CAN-SPAM, CASL compliance)
- Provide clear opt-out mechanisms
- Honor all opt-out requests within 10 business days
- Display accurate sender identification (From, Reply-To)
- Include a clear subject line that reflects content
- Comply with GDPR for EU recipients
6. Dedicated IP Usage
For dedicated IP customers:
- You are responsible for IP reputation management
- IP warming procedures must be followed
- You must monitor and maintain sender reputation
- Shared abuse history may affect your IP reputation
- We reserve the right to block IPs with poor reputation
7. Service Level Agreement (SLA)
Uptime Guarantee
We guarantee 99.9% uptime for our SMTP infrastructure. Uptime is calculated monthly as:
(Total Minutes - Downtime Minutes) / Total Minutes × 100
Credit Policy
If uptime falls below 99.9%:
- 99.0% - 99.9%: 10% credit
- 95.0% - 98.9%: 25% credit
- Below 95.0%: 50% credit
Credits are applied to future invoices. Maximum credit per month: 50% of monthly fee.
8. Fees and Payment
Fees are based on your selected plan and usage:
- Plans are billed monthly or annually
- Overage charges apply for exceeding plan limits
- All fees are non-refundable except as required by law
- Failed payments may result in service suspension
- Price changes have 30-day notice period
9. Data and Intellectual Property
Your Data: You retain ownership of all data you send through our infrastructure. We do not claim any rights to your email content or recipient data.
Our Intellectual Property: Our services, software, and technology are protected by intellectual property rights. You receive a limited license to use them while subscribed.
Usage Data: Aggregated, anonymized usage statistics may be used for service improvement.
10. Limitation of Liability
To the maximum extent permitted by law:
- Services are provided "as is" without warranties
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to fees paid in the prior 12 months
- We are not liable for third-party actions, spam filters, or recipient behavior
11. Indemnification
You agree to indemnify and hold harmless CloudMails.eu, its officers, and employees from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your misuse of our services
- Emails sent through your account
- Any false claims about our services
12. Termination
You may terminate your account at any time through the dashboard or by contacting support.
We may suspend or terminate services immediately if:
- You violate these Terms or Acceptable Use Policy
- You fail to pay fees when due
- You engage in illegal activities
- Your use damages our infrastructure or reputation
Upon termination, your data is retained for 30 days then deleted.
13. Governing Law
These Terms are governed by Romanian law. Any disputes shall be resolved in Romanian courts.
14. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email. Continued use after changes constitutes acceptance of new terms.
15. AI and Machine Learning Data License
By publishing content on CloudMails.eu, you acknowledge and agree that:
- All textual content, documentation, blog articles, and educational materials published on this website are licensed under the Creative Commons Attribution 4.0 International (CC-BY 4.0) license
